These Terms and Conditions (“Terms”) are an agreement between you and Tapo E-wallet (“Tapo”, “we”, “us”). They apply to your Tapo account, the Tapo website and app, and every service we provide through them (together, the “Service”). By creating an account or using the Service you agree to these Terms and to the Privacy section below. If you do not agree, do not use the Service.
1. What Tapo is — and is not
Tapo is an electronic wallet that lets you hold a balance, send money to other Tapo accounts, receive money, top up, cash out and use debit cards provided through Tapo. Tapo is not a bank or an authorised deposit-taking institution. Your balance is not a deposit, does not earn interest, and is not covered by the Australian Government’s Financial Claims Scheme or any other deposit guarantee.
2. Who can use Tapo
You must be at least 18 years old, able to enter into a binding contract, and not prohibited from using financial services under any law that applies to you. You may hold only one account. You must use the Service only for yourself and not on behalf of anyone else.
3. Your account and identity check
You must give us true, accurate and complete information and keep it up to date. Before your account can be used we check your identity: you agree to provide photos of an identity document (ID card, driver licence or passport) and a photo of your face taken with your device’s camera. We decide in our sole discretion whether to approve an account. We may ask for more information at any time, and we may refuse, limit, suspend or close an account where we are not satisfied with the information provided.
You are responsible for keeping your password and devices secure and for all activity on your account. Tell us immediately if you think someone else has accessed your account. To the extent permitted by law, we are not responsible for losses caused by you sharing your login details or failing to keep them secure.
4. Your balance and currencies
Your balance is held in Australian dollars (AUD). You may choose to view your balance or enter amounts in US dollars (USD). USD amounts are converted using the exchange rate we set at the time of the transaction, which may differ from rates offered by banks or shown elsewhere. The amount shown at confirmation is the amount that applies.
5. Sending and receiving money
Transfers are made using the receiver’s Tapo account number. Check the account number and amount before you confirm. Transfers are processed immediately and generally cannot be reversed. Cancelling a transfer requires the receiver’s consent, and we are not obliged to recover money sent to the wrong account. Be careful of scams: never send money to someone you do not know or trust. If you fall victim to a scam you may not get your money back, and, to the extent permitted by law, we are not liable for that loss.
Payment codes and QR codes are valid only for the time shown. You are responsible for making sure a code is genuine before you pay it.
6. Top-ups and cash-outs
Top-ups and cash-outs are processed after we review them. Processing times are estimates and are not guaranteed. We may decline, delay or reverse a top-up or cash-out, including where we cannot confirm a payment, suspect fraud or are required to by law. When you cash out, you are responsible for giving correct bank details; we are not responsible for payments made to details you provided. When you add a card, you confirm that you are the cardholder or are authorised to use it.
7. Debit cards
Virtual and physical debit cards are provided through a third-party card provider and are subject to that provider’s terms as well as these Terms. Card fees are shown before you request a card and are taken from your balance when you request it. Card fees are non-refundable, except where we reject your request. You can freeze your card in the app; freezing hides your card details and is passed on to the card provider, but you must still tell us straight away if your card is lost, stolen or used without your permission. We may cancel, suspend or replace a card at any time.
8. Fees
Fees for our services are shown in the app before you confirm. Transfers between Tapo accounts are currently free. We may introduce or change fees by updating the app or these Terms; changes do not affect transactions you have already confirmed.
9. Things you must not do
You must not use the Service for anything unlawful, including fraud, money laundering, terrorism financing, scams, gambling where it is illegal, or buying or selling illegal goods or services; to send money obtained unlawfully; to impersonate anyone; to interfere with the Service or its security; or in breach of sanctions. We may monitor transactions, refuse or hold any transaction, freeze funds, and report activity to the police or any regulator where we believe this is required or appropriate.
10. Suspending or closing your account
We may suspend, restrict or close your account, or refuse any transaction, at any time and without notice where we reasonably consider it necessary — including if you breach these Terms, we suspect fraud or unlawful activity, we are required to by law, or we stop offering the Service. You may ask us to close your account at any time. When an account is closed we will pay out any remaining balance that we are lawfully able to release, to an account in your name, after deducting any amounts you owe us.
11. Availability of the Service
The Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free, secure or available at any particular time, or that any particular feature will continue to be offered. We may change, suspend or stop any part of the Service at any time. We are not responsible for delays or failures caused by third parties, such as banks, card providers, internet or telecommunications providers, or events outside our reasonable control.
12. Our liability
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any law (including the Australian Consumer Law) that cannot lawfully be excluded or limited (“Non-excludable Rights”).
Subject to the Non-excludable Rights and to the maximum extent permitted by law:
- all warranties, representations and conditions not expressly set out in these Terms are excluded;
- we are not liable to you for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, opportunity, data or goodwill, however caused (including by negligence), arising out of or in connection with the Service or these Terms;
- we are not liable for any loss caused by your own acts or omissions, by information you give us that is wrong, by third parties (including people you send money to, card providers and banks), or by events outside our reasonable control; and
- our total liability to you for all claims arising out of or in connection with the Service or these Terms is limited to the total fees you paid us in the 12 months before the event giving rise to the claim.
Where our liability for a breach of a Non-excludable Right can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
13. Your responsibility to us
To the maximum extent permitted by law, you indemnify us and our officers, employees and contractors against any loss, liability, claim, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your unlawful use of the Service, or any information you provide that is false or misleading. We may deduct from your balance any amount you owe us under these Terms.
14. Privacy
We collect the information you give us (your name, email address, identity document photos and face photo) and information created when you use the Service (your account number, balance, transactions, cards, top-ups, cash-outs, saved card nickname, network, last four digits and expiry). We do not store the full number or security code of cards you add for top-ups.
We use this information to provide and secure the Service, verify your identity, process transactions, prevent fraud and other unlawful activity, comply with the law and contact you about your account. We may share it with service providers who help us run the Service (such as card providers, banks and hosting providers), with regulators, the police or courts where required or permitted by law, and with others with your consent. We take reasonable steps to protect your information, but no system is completely secure.
We keep your information for as long as your account is open and afterwards for as long as we need it for legal, regulatory and record-keeping purposes. You may ask us for access to, or correction of, the personal information we hold about you, or make a privacy complaint, through the contact details below. We handle personal information in accordance with the Privacy Act 1988 (Cth) where it applies to us.
15. Changes to these Terms
We may change these Terms at any time by publishing the updated version in the app or on our website. If a change is significant we will tell you in the app or by email before it takes effect. If you keep using the Service after a change takes effect, you accept the changed Terms. If you do not agree, you may close your account.
16. General
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. If any part of these Terms is invalid or unenforceable, it is read down or severed to the extent necessary and the rest continues to apply. Our failure to enforce any right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor of the Service. These Terms are the entire agreement between you and us about the Service.
17. Contact us
